KEY TERMS
Contract Type
This is a monthly rolling storage agreement which continues until terminated by either party in accordance with these Terms and Conditions.
Notice Period
Customers may terminate this agreement at any time by providing at least 30 days' written notice.
Storage Fees
Storage fees must be paid in advance and on time.
Ownership of Goods
You confirm that you own the goods stored or have authority from the owner to store them.
Customer Responsibility
Goods are stored entirely at your own risk.
Insurance
You must maintain adequate insurance cover for all goods stored.
Access
Access is subject to site opening hours and compliance with these Terms.
Prohibited Goods
Hazardous, illegal, explosive, dangerous or environmentally harmful goods must not be stored.
Default
Failure to pay storage fees may result in access restrictions, removal of goods and enforcement of our lien rights.
1. STORAGE LICENCE
1.1 Subject to payment of all fees, Plowright Storage grants the Customer a personal licence to store goods within the allocated container or storage unit.
1.2 This agreement creates a licence only and does not create a tenancy, lease or exclusive possession of any land.
1.3 Plowright Storage does not take possession of the goods and is not a bailee, warehouseman or custodian.
1.4 The Customer warrants that:
- They own the goods or are authorised to store them.
- The goods are legal and compliant with all applicable laws.
- The goods are suitable for storage within a shipping container environment.
2. STORAGE FEES
2.1 Storage fees are payable monthly in advance.
2.2 Payment shall be made by direct debit, standing order, debit card, credit card or other approved method.
2.3 Fees may be increased by providing at least 30 days' written notice.
2.4 Late payments may incur:
- Late payment charges;
- Administrative fees;
- Debt recovery costs.
2.5 The Customer remains liable for all fees until the unit is completely vacated and returned.
3. SECURITY AND ACCESS
3.1 Access is permitted only during published access hours unless otherwise agreed.
3.2 Customers are responsible for:
- Securing their own container;
- Providing their own lock;
- Keeping access credentials confidential.
3.3 Customers must not:
- Allow unauthorised persons access;
- Tailgate through gates;
- Interfere with security systems.
3.4 Plowright Storage may suspend access where:
- Fees are overdue;
- Site safety is compromised;
- These Terms are breached.
4. PROHIBITED GOODS
The following must not be stored:
- Explosives
- Firearms
- Ammunition
- Gas cylinders
- Petrol, diesel or fuels
- Flammable liquids
- Hazardous chemicals
- Toxic substances
- Radioactive materials
- Waste materials
- Asbestos
- Perishable food
- Livestock or animals
- Illegal or stolen goods
- Counterfeit products
- Controlled substances
- Any item likely to cause nuisance, odour, contamination or damage
Plowright Storage may immediately remove or report prohibited goods where necessary.
5. CONDITION OF UNIT
5.1 The Customer accepts the storage unit in its existing condition.
5.2 The Customer is responsible for ensuring the unit is suitable for their goods.
5.3 No alterations may be made to containers, fences, gates or site infrastructure.
5.4 Any damage caused by the Customer shall be repaired at the Customer's expense.
6. INSURANCE
6.1 Plowright Storage does not insure the Customer's goods.
6.2 The Customer is responsible for obtaining and maintaining insurance cover.
6.3 The Customer accepts that all goods are stored entirely at their own risk.
7. LIMITATION OF LIABILITY
7.1 To the maximum extent permitted by law, Plowright Storage shall not be liable for:
- Theft;
- Fire;
- Flood;
- Water damage;
- Vermin;
- Mould;
- Condensation;
- Rust;
- Corrosion;
- Business interruption;
- Loss of profits;
- Indirect or consequential loss.
7.2 Nothing in these Terms excludes liability for:
- Death or personal injury caused by negligence;
- Fraud;
- Any liability which cannot legally be excluded.
8. CUSTOMER INDEMNITY
The Customer shall indemnify and keep indemnified Plowright Storage against any claims, losses, liabilities, costs and expenses arising from:
- Breach of these Terms;
- Storage of prohibited goods;
- Damage caused by the Customer;
- Any unlawful activity.
9. SITE RULES
Customers must:
- Drive carefully on site;
- Observe speed limits;
- Keep gates closed where required;
- Dispose of waste responsibly;
- Respect neighbouring occupiers.
Customers must not:
- Operate a business from the site;
- Use the unit as an office;
- Use the site as a workshop;
- Carry out repairs or manufacturing;
- Sleep or reside within any container.
10. PLOWRIGHT STORAGE'S RIGHT OF ENTRY
10.1 We may enter a unit where reasonably necessary:
- For emergency purposes;
- To prevent damage;
- To investigate suspected breaches;
- To comply with legal obligations;
- To relocate goods where necessary.
10.2 Wherever reasonably practicable we will provide prior notice.
11. NON-PAYMENT AND LIEN
11.1 If fees remain unpaid after the due date, Plowright Storage may:
- Restrict site access;
- Disable entry credentials;
- Apply late payment charges;
- Recover debt collection costs.
11.2 If fees remain unpaid for 60 days or more, Plowright Storage may begin enforcement procedures.
11.3 Following written notice and in accordance with applicable law, Plowright Storage may:
- Remove goods;
- Sell goods;
- Dispose of goods where appropriate.
11.4 Sale proceeds shall first be applied against:
- Outstanding fees;
- Costs of enforcement;
- Storage charges;
- Legal expenses.
11.5 Any remaining balance shall be held for collection by the Customer.
12. ABANDONED GOODS
12.1 Goods left after termination shall be deemed abandoned.
12.2 Plowright Storage may remove, dispose of or sell abandoned goods following reasonable notice.
12.3 The Customer remains liable for all associated costs.
13. TERMINATION
13.1 Either party may terminate this agreement by giving 30 days' written notice.
13.2 Plowright Storage may terminate immediately where:
- Illegal activity is suspected;
- Fees remain unpaid;
- Site rules are repeatedly breached;
- Dangerous goods are stored.
13.3 All goods must be removed before the termination date.
14. CCTV, SECURITY AND DATA PROTECTION
14.1 The site operates CCTV and may operate ANPR systems for security and operational purposes.
14.2 Personal data shall be processed in accordance with:
- UK GDPR;
- Data Protection Act 2018.
14.3 Information may be shared where required:
- By law;
- For debt recovery;
- For fraud prevention;
- For crime prevention and detection.
15. GENERAL
15.1 Plowright Storage may amend these Terms by providing at least 30 days' written notice.
15.2 If any provision is found invalid, the remaining provisions shall remain in force.
15.3 Failure to enforce any right does not constitute a waiver of that right.
15.4 These Terms constitute the entire agreement between the parties.
16. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
The Courts of England and Wales shall have exclusive jurisdiction in relation to any dispute arising from this Agreement.
CUSTOMER DECLARATION
I confirm that:
- I have read and understood these Terms and Conditions.
- I agree to be bound by them.
- I am the owner of the goods stored or am authorised to store them.
- I understand that my goods are stored entirely at my own risk.
- I understand that Plowright Storage does not provide insurance for my goods.
